These Terms of Use and End User License Agreement (the "Terms" or "Agreement") are a legally binding agreement between you and Tran Duy Ngoc ("Wumarino," "we," "us," or "our") regarding your access to and use of the Wumarino mobile application and related services (the "App").

By downloading, installing, accessing, or using the App, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the App.

Wumarino is a digital utility and lifestyle enhancement application designed to streamline workflows, organize personal data, and elevate your daily digital experience.

Important: Wumarino is a tool designed to assist you. Users are solely responsible for how they utilize the App and the data they choose to input or manage within it.

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not violate any applicable local, national, or international laws. You agree not to copy, scrape, reverse engineer, decompile, or commercially exploit the App. You must not attempt to bypass security controls, interfere with the App's servers, or use the App for any illegal, harmful, or malicious purposes.

The App may be free to download, but access to certain premium features may require a paid subscription ("Subscription"). Purchases and subscriptions in the iOS version are processed through the Apple App Store. Purchases and subscriptions in the Android version are processed through Google Play. Recurring subscriptions automatically renew unless cancelled or disabled through the applicable app-store account settings. Uninstalling or deleting the App does not cancel an active Subscription.

Your use of the App is governed by our Privacy Policy. We employ strict, industry-standard data protection measures, and we do not sell your personal data to third parties.

These Terms are between you and Tran Duy Ngoc, not Apple or Google. Your use of the App may also be subject to applicable Apple App Store, Apple Media Services, Google Play, device, wireless carrier, and other third-party terms and policies.

The App, including its software, design, interface, text, organization, trademarks, logos, and other content or materials provided by Wumarino (collectively, "App Content"), is owned by Tran Duy Ngoc or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

We do not guarantee that the App will work with every hardware, software, device, network, or operating-system configuration. The App may be temporarily unavailable because of maintenance, updates, or technical failures. While we implement reasonable security measures to protect your data, Wumarino does not guarantee uninterrupted, completely secure, or error-free operation.

To the fullest extent allowed by applicable law, you agree to defend, indemnify, and hold harmless Tran Duy Ngoc, its affiliates, and their respective officers, directors, employees, contractors, and agents from and against any claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising from your misuse of the App or your violation of these Terms.

To the maximum extent permitted by applicable law, the App and App Content are provided on an "as is" and "as available" basis. We disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy.

To the maximum extent permitted by applicable law, Tran Duy Ngoc and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or loss of use, arising from your use or inability to use the App.

We may modify, suspend, or discontinue the App or any part of it at any time. We may also update these Terms from time to time. Your continued use of the App after updated Terms are posted means you accept the updated Terms.

Informal Resolution: Before starting a formal dispute, you agree to contact us at caodinhcong9888@icloud.com and describe the issue. We will try to resolve the dispute informally.

Arbitration and Class Action Waiver: If you are located in the United States, you and Wumarino agree that disputes arising out of or relating to the App or these Terms will be resolved by individual binding arbitration, except that either party may bring an individual claim in small claims court if it qualifies. You and Wumarino waive the right to participate in a class action, class arbitration, or representative action to the extent permitted by applicable law.

You represent that you are not located in a country or region subject to applicable embargo or sanctions that prohibit your use of the App. You are responsible for complying with all laws that apply to your use of the App.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect. You may not assign these Terms or your rights or obligations without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
